Objectives of NDPS Act 1985:

  • ¨ To promote international cooperation in combating the illicit drug trafficking.
  • ¨ To protect the public from the harmful effects of narcotic drugs and psychotropic substances.
  • ¨  To make provisions for the implementations of International Conventions relating to Drugs and Psychotropic Substances to which India is a party.
  • To limit the use of narcotic substance like morphine, Codeine in common people.
  • TO limit the import, export of Narcotic and psychotropic substance from or to the country.

Cultivation of Poppy Straw:

The cultivation of poppy straw can be carried out by approvement of Central Govt. in the specified parts of the country (MP, Rajasthan, UP) according to the license issued by the district Opium officer. 

Application should be made including the following informations after the payment of the prescribed fees:

  1. Name, Father's name address of the cultivator.
  2. Name of the plot owner with Khasra number of the plot. 
  3. Year and Area required for the cultivation. 
  4. Sign of the cultivator and Lambarder with seal.

  • For the cultivation of Opium license are issued by the District Opium Officers.
  • ¨  The license granted by the District Opium officer may be cancelled by higher officers after giving the chance for cultivation also.
  • ¨  If opium is cultivated under a license which is cancelled, the crop may be destroyed under the supervision of an authorized officer, specified by the narcotic commissioner.

Production of Poppy Straw:

  1. During Harvesting, cultivators shall daily record their cultivated opium weight to the Lambarder and should jointly attested every day.
  2. These records should be checked by an authorized officer. 
  3. If any mismatch happens between quantity produced and quantity entered in the records, an enquiry shall be made by authorized officer to determine the punishment for the cultivator.
  4. All the produced opium shall be delivered to District Opium Officer who will weight it again, ana classify the Opium as per the quality produced and forward it to Government Opium Factory specified by Narcotic Commissioner
  5. All the opium forwarded to the Government Factory Must be classified under the supervision of General Manager.
  6. If the district Opium officer found any adulterant Opium, he may send it separately to the Government Opium factory after sealing in the presence of cultivator and Lambarder.
  7. The central government time to time fixes the price of opium, to be paid to the cultivator. Such price shall be fixed for Kg of standard opium.
  8. The central government may also allow the cultivation of opium poppy only for the production of poppy straw. 

Sale of poppy straw:

Opium can be sold to State Government or manufacturing chemists only from the government opium factories. 
The selling prize for the opium is fixed by the Central Government.

Some provisions Related to the sale are:

  1. The sale of the opium to the state government can be carried out only on the permission of the central government.
  2. The sale of opium to the manufacturing chemists or other institutions can be carried out under the permission of the state Govt.
  3. The issue by the state govt. is in 4 copies. of which 3 copies are send to the Government opium factories and remaining 1 copy is taken by the issuing authority/state govt.
  4. The price for the sale of opium poppy is fixed by the central govt. time to time.
